Kenpong Travel and Tours Limited has strongly dismissed reports suggesting the company is facing liquidation, insisting that legal processes surrounding a long-running debt dispute with First Atlantic Bank are still before the Court of Appeal.
The company’s response follows the emergence of a winding-up petition reportedly filed by First Atlantic Bank at the General Jurisdiction Division of the High Court in Accra.
The petition seeks to place the travel company into liquidation over an alleged unpaid judgment debt of GH¢2,549,969.28 arising from an earlier court ruling.
According to documents filed by the bank through its solicitors, Kwame Akufo & Co. Unlimited, the application stems from a judgment delivered on August 15, 2022, in Suit No. CM/BFS/1191/2019, titled First Atlantic Bank v. Kenpong Travel and Tours Limited and Five Others.
The bank contends that despite the judgment, the company has failed to settle the outstanding debt, which continues to attract interest at prevailing commercial rates. The original judgment also awarded GH¢20,000 in legal costs against Kenpong Travel and Tours.
The bank argues that the company’s alleged inability to satisfy the judgment debt justifies the commencement of winding-up proceedings under Ghana’s insolvency laws.
However, Kenpong Travel and Tours has rejected suggestions that it is insolvent or on the verge of liquidation. In a statement issued through its lawyers, Atta Akyea & Co., the company maintained that it had not been formally served with the petition despite reports that it was filed on May 4, 2026.
The company questioned why a petition allegedly filed several weeks earlier had not been served on it before details surfaced in the media, describing the development as professionally questionable and potentially damaging to its reputation.
According to the company’s legal representatives, the timing of the publication appears calculated to undermine the confidence of customers and business partners at a period when Kenpong Travel and Tours is actively providing travel services to Ghanaians travelling for the ongoing FIFA World Cup.
The lawyers further disclosed that the company had already exercised its legal right to challenge the 2022 High Court judgment. They explained that on September 27, 2022, Kenpong Travel and Tours filed an appeal at the Court of Appeal disputing both the legal basis of the judgment and the amount awarded against it.
They added that the appeal process has since progressed, with the Record of Appeal fully compiled and Form 6 issued on April 13, 2026, indicating that the appeal remains active and yet to be determined.
Kenpong Travel and Tours therefore maintains that the dispute remains before the appellate court and insists that reports portraying the company as being under liquidation are misleading.
