The Court of Appeal’s decision to overturn the conviction of former Microfinance and Small Loans Centre (MASLOC) Chief Executive Officer, Sedina Christine Tamakloe Attionu, was based on multiple legal and evidential shortcomings in the prosecution’s case, with the court holding that the trial judge improperly shifted the burden of proof onto the accused and relied on evidence that failed to meet the required legal standard.
In a detailed 94-page unanimous judgment delivered on Thursday, July 30, the three-member panel of Justice Emmanuel Ankamah, Justice Emmanuel Senyo Amedahe and Justice Samuel Obeng-Diawuo held that the prosecution failed to establish the offences beyond reasonable doubt and that several of the convictions could not be sustained in law.
